Terms of Use

These Terms of Use ("Terms") govern your use of The Horse Source, a horse-listing and discovery marketplace operated by The Horse Source LLC ("The Horse Source," "we," "us," or "our"). By using the service, you agree to these Terms.

Marketplace role

The Horse Source provides technology that helps buyers and sellers discover horses and communicate. We are not the owner, seller, buyer, broker, auctioneer, veterinarian, trainer, transporter, insurer, or agent for horses listed by users unless we expressly state otherwise for a specific transaction.

Any purchase, sale, lease, trial, transportation arrangement, veterinary examination, payment between users, or other horse transaction is solely between the applicable users. Users are responsible for evaluating each other and the horse, negotiating terms, documenting agreements, and complying with law.

Accounts and eligibility

You are responsible for information and activity associated with your account and for maintaining the security of your sign-in credentials. Information you provide must be accurate and must not impersonate another person or misrepresent your authority to act for an owner, farm, business, or other party.

If you are not old enough to enter binding contracts where you live, you may use transaction-related features only with the involvement and permission of a parent or legal guardian.

Listings

Sellers are responsible for the accuracy, legality, ownership authority, and completeness of their listings. Listings must not intentionally conceal material information or contain false, misleading, fraudulent, infringing, abusive, or unlawful content.

Paid listings are offered for the period shown at checkout. The current marketplace offering is a 30-day listing. Renewal or relisting requires the applicable fee shown at the time of purchase. We may change pricing prospectively, but a change does not alter a listing period already purchased.

Fees and payments

Marketplace listing fees are processed through our payment provider. Except where required by law or expressly stated otherwise, fees for a listing that has been successfully published are non-refundable. You are responsible for any taxes or other obligations that apply to your own transaction activity.

Buyer diligence and equine risk

Horses are living animals and equine activities involve inherent risks. Listing information, photos, videos, descriptions, performance claims, health statements, and representations come from users unless specifically identified otherwise. The Horse Source does not independently verify every claim.

Buyers should conduct whatever due diligence they consider appropriate before a transaction, including identity and ownership verification, an independent prepurchase examination by a veterinarian of the buyer's choosing, review of records, and a written purchase or lease agreement. No information on the service is a substitute for veterinary, legal, financial, insurance, or other professional advice.

Fraud, scams, and prohibited conduct

You may not use the service to commit fraud, facilitate scams, misrepresent ownership or identity, manipulate marketplace activity, harass users, distribute malware, scrape or access the service in an abusive automated manner, evade account restrictions, or violate applicable law or another party's rights. We may investigate suspicious activity and restrict or remove content or accounts when reasonably necessary to protect the marketplace.

Messages and contact sharing

Marketplace messages are intended to support legitimate horse-related inquiries. Do not send unlawful, threatening, deceptive, or abusive communications. Contact information is shared between users only when a user chooses to share it through available contact-sharing features or otherwise provides it directly.

User content

You retain ownership of content you submit. You grant The Horse Source a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and distribute that content as needed to operate, promote, secure, and improve the marketplace and to display your active listings. This license ends when the content is deleted from active systems, except to the extent retention is reasonably needed for backups, security, legal compliance, or dispute resolution.

You represent that you have the rights and permissions necessary to upload and use the content you submit, including photos and videos.

Service availability and changes

We may modify, suspend, discontinue, test, or update features of the service. We do not guarantee that the service will always be uninterrupted, error-free, or available at a particular time or on a particular device.

Disclaimers

To the maximum extent permitted by law, the service is provided "as is" and "as available." The Horse Source disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not guarantee the identity, conduct, solvency, authority, statements, horses, or transaction performance of marketplace users.

Limitation of liability

To the maximum extent permitted by law, The Horse Source LLC and its owners, affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, loss of data, loss of opportunity, or damages arising from a transaction or interaction between marketplace users.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service will not exceed the greater of the amount you paid directly to The Horse Source during the 12 months preceding the event giving rise to the claim or $100. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Horse Source LLC and its affiliates, owners, officers, employees, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your listings, content, transactions, violation of these Terms, or violation of another party's rights.

Suspension and termination

We may suspend or terminate access, remove listings, or limit features when we reasonably believe it is necessary for security, fraud prevention, legal compliance, enforcement of these Terms, or protection of users or the marketplace. You may stop using the service at any time.

Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Any dispute not subject to a mandatory alternative forum under applicable law will be brought in a court of competent jurisdiction in Kentucky.

Changes to these Terms

We may update these Terms as the marketplace evolves. If a change is material, we may provide additional notice where appropriate. Continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.
